EB-1A vs EB-1B vs EB-1C: What Is the Difference?

What is the difference between EB-1A and EB-1B?

EB-1A is for individuals with extraordinary ability in any field -- sciences, arts, education, business, or athletics. It allows self-petitioning (no employer required) and requires demonstrating national or international acclaim through major awards or at least 3 of 10 specific criteria. EB-1B is specifically for outstanding professors and researchers and requires a job offer for a permanent position at a university or qualifying research organization. The EB-1B standard is "outstanding" rather than "extraordinary," which is generally somewhat lower, and membership criteria are narrower (2 of 6 specific academic criteria).

Can I self-petition for EB-1?

Only EB-1A allows self-petitioning -- you can file Form I-140 on your own behalf without an employer sponsor. EB-1B and EB-1C both require an employer to file on your behalf. For EB-1B, the employer must be a university or qualifying research organization offering a permanent position. For EB-1C, the employer must be a multinational company with a qualifying relationship to the foreign entity where you worked.

Does EB-1 require a PERM labor certification?

No. All three EB-1 subcategories (EB-1A, EB-1B, EB-1C) are exempt from the PERM labor certification requirement. PERM is the process where employers must demonstrate that no qualified U.S. worker is available for the position, which can take 12-24+ months. Bypassing PERM is one of the primary advantages of the EB-1 category over EB-2 (except EB-2 NIW) and EB-3.
