H-1B Lottery 2027: Registration Dates, Odds & How to Maximize Your Chances

Every year in March, hundreds of thousands of foreign professionals wait to learn whether their employer's H-1B registration was selected in USCIS's electronic lottery. For most beneficiaries, this is the only path to US work authorization that is not time-limited or employer-dependent in the way that L-1, O-1, or TN visas are. And for most of them, the odds are not good.

How the H-1B cap and lottery work

Congress sets the annual H-1B cap at 65,000 regular cap slots plus 20,000 slots reserved for beneficiaries with a US master's degree or higher (the "master's cap"). USCIS runs the lottery in two rounds: first it selects 20,000 registrations from the master's-cap pool, then it selects the remaining 65,000 from all other registrations (including any master's cap registrations not selected in the first round). This means holders of US advanced degrees get two chances — one in the master's pool, one in the general pool. The lottery is conducted electronically using USCIS's online registration system. Employers pay $10 per registration (as of recent rule changes) and submit one registration per beneficiary per fiscal year.

FY2027 registration timeline

USCIS typically opens H-1B registration in early March (exact dates announced in February). The registration window is open for approximately two weeks, after which USCIS conducts the lottery and notifies selected registrants. For FY2027 (October 1, 2026 start), registration will open in approximately March 2027. Selected petitions must be filed between April 1 and June 30, 2027, and H-1B status begins October 1, 2027 at the earliest. Cap-gap protection applies to F-1/OPT beneficiaries selected in the lottery — their OPT and any related employment authorization remain valid through September 30, 2027.

Selection odds and what affects them

In recent years, USCIS has received 400,000 to 780,000 registrations for 85,000 slots. That yields overall odds of roughly 11% to 22% depending on the year, before accounting for the master's cap advantage. Beneficiaries with US master's degrees or higher have approximately 1.3x to 1.5x better odds than those without. Multiple registrations from different employers for the same beneficiary increase selection odds proportionally — if you have two qualifying employers each submitting a registration, your odds roughly double. USCIS conducts beneficiary-level deduplication to prevent abuse, but legitimate multiple-employer registrations (for genuinely separate job offers) are permitted.

If you are not selected: your alternatives

Not being selected is the majority outcome. Options include: (1) Stay on OPT or STEM OPT if still within the authorized period, and try again next year. (2) Pursue O-1A if your credentials qualify — no cap, no lottery, can be filed any time. (3) Consider TN if you are Canadian or Mexican and your role qualifies. (4) Look for cap-exempt employers: nonprofits, universities, and government research organizations can hire H-1B workers outside the cap. Many universities have cap-exempt H-1B slots. (5) Pursue L-1 if your employer has foreign operations and you can work abroad for 1 year to establish qualifying L-1 eligibility. (6) Consider an EB-1A or NIW self-petition if your work meets the standard — these lead directly to a green card without H-1B.

What is the difference between cap-subject and cap-exempt H-1B?
