What is a priority date?

Your priority date is your place in line for a green card. For most employment-based cases it is the date your employer filed your PERM labor certification; if no PERM is required, it is the date USCIS received your I-140 petition. You'll find it printed on your I-140 approval notice.

Each month the State Department publishes the Visa Bulletin, which lists a Final Action Date for every category and country. When your priority date is earlier than that cutoff, your date is “current” and you may be able to file Form I-485 or have a pending I-485 approved.

Because demand shifts, cutoffs can move forward, stall, or even retrogress backward — as EB-2 India did in July 2026. Tracking the bulletin monthly is the only way to know the moment your date becomes current.

Frequently asked questions

What is a priority date?

Your priority date is the date USCIS received your PERM labor certification (or your I-140 petition if no PERM is required). It marks your place in line for an immigrant visa number and is shown on your I-140 approval notice.

What does it mean for my priority date to be current?

Your priority date is current when it is earlier than the Final Action Date published for your category and country of birth in the monthly Visa Bulletin. When current, you may be eligible to file or have your I-485 approved.

Why did EB-2 India move backward in July 2026?

EB-2 India retrogressed 13 months in July 2026 because demand for visa numbers exceeded the annual per-country allocation, forcing the State Department to move the Final Action Date back to December 1, 2012.
